November 10, 2003 - $1 Million Settlement in TBI Case
A $1 million settlement was reached after jury selection but prior to trial in a personal injury case stemming from a motor vehicle accident in Northampton Township, according to court papers.
On June 6, 2001, plaintiff Margaret Vietro was injured in a vehicle accident with a tractor-trailer in Lower Mount Bethel Township, Northampton County, court papers said. She was hospitalized for two days. During that time, she was diagnosed with a possible brain contusion. She was subsequently diagnosed with mild/moderate traumatic brain injury and resulting depression, plaintiff's counsel said.
The plaintiff commenced suit against the tractor-trailer driver, Harry Fetterman, and the trucking company that employed him, the Rollin Johnson Trucking Inc. The plaintiff alleged that she was permanently and totally disabled from her position as an executive secretary as a result of her injuries. She was 53 years old at the time of the accident and was earning $30,000 per year.
The settlement was reached just before a trial was scheduled to begin.
Counsel for the defense acknowledged that the plaintiff had suffered serious and permanent injuries as a result of the accident, and said that the defense believed the settlement was fair and equitable under the circumstances.
